H.T. was convicted today of scamming dozens of elderly people out of $2.8 million. He pleaded guilty to twenty-nine counts of felonies ranging from 1997 to 2007. Many of his clients were actually parishioners of his father's church. H.T. told his clients that they were investing in tax-free municipal bonds and he even provided fake documents to convince them that their money had been invested. However, H.T. kept the money for himself instead of investing it. With the funds he pocketed, he bought a home in Coto de Caza, property in Mammoth, vehicles, and a golf club membership. He is facing up to eighteen years in prison for fraud.

Lindsey Lohan's Stolen Necklace

Lindsey Lohan was charged with stealing a $2,500 necklace from a jewelry store. Her lawyers were successful with their penal code section 17(b) motion which reduced the charges from a
 felony to a misdemeanor.

Many criminal charges can be filed as either misdemeanors or felonies, at the discretion of the prosecuting attorney. Even if the district attorney files a case as a felony, the defense attorney, can file a 17b motion and ask the court for the reduction. 17b motions can be filed during the time when the case is open or after the case has been plead out. If the motion is filed during the time that the case is open, usually the judge will look at the circumstances of the offense and the prior criminal history of the defendant when determining whether or not to grant the motion.

If the motion is filed after the case is closed, then as long as the case is a wobbler and the defendant finished probation without ever being sent to prison, the court should grant the motion.

One charge that is a wobbler but in Orange County is almost always charged as a felony is possession of methamphetamine (health and safety code section 11377a.)

In many cases of criminal offense accusations and/or arrests, an Orange County criminaI defense attorney, such as those at Takakjian & Sitkoff have been able to successful in convince the judge to reduce charges to misdemeanors event though the district attorney filed it as a felony.

Google Self Driving Cars Could End DUIs

Google has been test driving automated cars. Many of us have seen the Google cars (with a driver in the car) driving around the 405 freeway. Google is currently lobbying in Nevada for new laws that would make Nevada the first state to allow driver-less cars on the road.

"One of the big problems we're working on today is car safety and efficiency. Our goal is to help prevent traffic accidents, free up people's time and reduce carbon emissions by fundamentally changing car use," said a Google engineer on the company's blog posting.

Imagine the effect automated or self driving cars could have on criminal laws. People could use the cars to help avoid DUIs, effectively ending the law breaking caused by drivers who are arrested and charged with drinking and driving. People could avoid a DUI by having their car take them home. There would not longer be the need for a personal driver, a taxi cab, or bus fare because an individual's car would be able to sufficiently carry one safely home without breaking the law.

However, these new vehicles have not been released yet, and there is no date on the horizon as to when they will be. Therefore, accusations and arrests are still being frequently applied by law enforcement. If you or someone you now has recently recieved a DUI, then an Orange County criminal defense lawyer can help defend your case, in or out of the court room.

Contact an Orange County DUI attorney to get aggressive defense against your charge.
